Strict Liability

California follows one of the most victim-friendly dog bite laws in the country.

California Civil Code Section 3342 imposes strict liability for dog owners.
Generally, under California's dog bite statute, an owner is liable for the injuries their dog causes by biting a person who is either in a public place or lawfully on private property (including the owner's property), regardless of whether the dog has ever bitten anyone before and regardless of the owner's knowledge of the dog's temperament. California does not require you to prove the owner knew the dog was dangerous — the bite itself is generally enough to establish liability.

What to Do After a Dog Bite

1. Seek medical attention immediately, even for bites that seem minor — dog bites carry a real risk of infection and may need professional wound care, stitches, or a rabies risk evaluation.
2. Report the incident to local animal control or law enforcement, which creates an official record.
3. Get the owner's contact and insurance information, if possible, along with proof of the dog's vaccination history.
4. Photograph your injuries and the location where the attack occurred.
5. Get contact information from any witnesses.
6. Avoid giving a recorded statement to an insurance company before speaking with an attorney — insurers may use early statements to minimize your claim.
